Terms and Conditions

These Terms and Conditions govern membership of the Akasa Elevate Programme and apply to all Members. By applying to join, you confirm that you have read, understood, and accepted these Terms and Conditions. Members are encouraged to review the latest version of the Terms and Conditions available on the Akasa website. Continued participation in the programme will be considered as acceptance of any updates.

  1. Akasa Elevate Program is a loyalty programme owned and managed by SNV Aviation Private Limited (“Akasa”).
  2. The Terms and Conditions (defined hereinafter) encapsulated hereinafter in this membership agreement (“Membership Agreement” or “Agreement”) shall govern the relationship between Akasa and each individual enrolled in the Akasa Elevate Programme.
  3. Participation in Akasa Elevate Programme by a Member is subject to these Terms and Conditions.
  4. Akasa may amend, modify, suspend, or discontinue the Akasa Elevate Programme and/or these Terms and Conditions from time to time for operational, legal, regulatory, or business reasons. Any material changes that adversely affect Members' rights, benefits, or obligations under the Akasa Elevate Programme shall be communicated to Members through the Akasa Website, Mobile Application, email, or such other channels as Akasa may determine, at least thirty (30) days prior to such changes taking effect, unless a shorter notice period is required by Applicable Law, regulation, or circumstances beyond Akasa's reasonable control. Continued participation in the Akasa Elevate Programme after the effective date of the changes shall constitute acceptance of the revised Terms and Conditions. Members who do not agree to the revised Terms and Conditions may terminate their participation in the Akasa Elevate Programme in accordance with these Terms and Conditions.
  5. It is each Member’s responsibility to read and understand the Terms and Conditions before undertaking participation in the Akasa Elevate Programme.
  6. These Terms and Conditions are supplementary to, and shall be read together with, Akasa's Conditions of Carriage ( Conditions of Carriage | Akasa Air ). In the event of any inconsistency relating to the carriage of passengers or baggage, the Conditions of Carriage shall prevail.
  7. Capitalised terms used throughout the Agreement shall have the meaning ascribed to them in clause II (Definitions) of the Agreement.

  1. Unless the context otherwise requires or unless otherwise defined or provided for herein, capitalized words and expressions used herein but not specifically defined shall have the same meaning as attributed to them in the following manner:

    “Accrual Activity” or “Earn Activity” means any eligible activity, transaction, purchase, booking or engagement with Akasa, an Akasa Elevate Programme Partner or otherwise designated by Akasa from time to time under the Programme, through which a Member may earn Elevate Points in accordance with these Terms and Conditions.

    An activity or transaction shall qualify as an Accrual Activity only to the extent paid for using eligible monetary consideration and shall not include any portion of a transaction paid for through the redemption of Elevate Points, unless expressly permitted by Akasa.

    Where the underlying product or service is cancelled, returned, refunded (in whole or in part) or otherwise reversed, Akasa may disqualify the relevant activity from earning Elevate Points and reverse any Elevate Points credited in respect of such activity.

  2. “Akasa Elevate Member(s)” or “Member(s)” means an individual who is enrolled as a member using their unique mobile number and unique email ID and holds a valid Akasa Elevate Membership Account.
  3. “Akasa Elevate Membership Account” refers to a unique account created for each Member during their enrolment in the Loyalty Programme. This Akasa Elevate Membership Account is where Elevate Points are credited against Accrual Activities, Tier status is assigned, Tier Benefits are awarded and where Elevate Points or Tier Benefits can be redeemed for redemption activities or for such other qualifying activities as may be designated by Akasa from time to time in accordance with these Terms and Conditions.
  4. “Akasa Elevate Membership ID” or “Membership ID” refers to a 9-digit unique identifier number provided to a Member at the time of enrolment, in connection with products, services, offers or transactions provided to Akasa Elevate Members by Akasa and/or Akasa Elevate Programme Partners.
  5. “Akasa Elevate Programme Partner” or “Programme Partner” means any and all airlines, banks, hotels, restaurants, car rental companies, retail stores, financial services providers, and other establishments that have partnered with Akasa to offer their respective products/services to the Members as part of the Programme.
  6. “Akasa Flight(s)” or “Flight(s)” means flights marketed and operated by Akasa and bearing flight numbers starting with the airline code QP.
  7. “Akasa Website” or “Akasa Mobile App” shall refer to the www.akasaair.com website or mobile application where the Akasa Elevate Programme details are reflected, and a Member can log in to their respective Akasa Elevate Membership Account.
  8. “Applicable Law(s)” means any applicable law, statute, bye-law, regulation, order, regulatory policy (including any requirement or notice of any regulatory body), regulatory body's notice, guidance or industry code of practice, rule of court, or directives, delegated or subordinate legislation in force from time to time.
  9. “Award” or “Redemption” or “Burn” refers to such activity that results in the utilization of Elevate Points by a Member for booking flight tickets, ancillaries, add-ons, or other eligible products and services of Akasa in accordance with these Terms and Conditions.
  10. “Base Elevate Points” refer to the standard minimum earning of Elevate Points for an Accrual Activity in relation to Akasa or an Akasa Elevate Programme Partner.
  11. “Base Fare” shall refer to such portion of the fare of an Akasa Flight ticket, paid in Indian Rupees (INR) or any other fiat currency, on which Elevate Points may be accrued. Base Fare is calculated as the sum of the base fare of a ticket and the fuel surcharge (YQ) payable.
  12. “Bonus Elevate Points” refer to additional Elevate Points earned by a Member over and above the Base Elevate Points earned for an Accrual Activity or any other activity as determined by the Programme.
  13. “Direct Channel Bonus Elevate Points” refers to such additional Elevate Points earned by a Member over and above the Base Elevate Points for bookings made on the Akasa Website or Akasa Mobile App.
  14. “Elevate Point(s)” is the unit currency of the Programme. Akasa Elevate Members are awarded Elevate Points for eligible Accrual Activities in accordance with the Terms and Conditions.
  15. Force Majeure Means any event or circumstance beyond the reasonable control of Akasa which could not reasonably have been foreseen, avoided or overcome by Akasa, and which prevents, hinders or delays Akasa's performance of its obligations under the Programme.

    Such events may include, without limitation:

    a. war, invasion, armed conflict, terrorism, sabotage, civil unrest, riot or insurrection;

    b. natural disasters, including earthquake, flood, cyclone, hurricane, typhoon, storm, volcanic activity or other extreme weather events;

    c. epidemic, pandemic, public health emergency or quarantine restriction;

    d. acts of government, regulatory restrictions, sanctions, embargoes or closure of airspace;

    e. widespread failure or disruption of utilities, telecommunications networks, internet services, payment systems or technology infrastructure;

    f. cyber-attacks, system outages, data centre failures or other information technology disruptions; and

    g. any other event or circumstance beyond the reasonable control of Akasa having a similar effect.

  • Fraud or Fraudulent Activity(ies)
    For the purpose of these Terms and Conditions shall mean fraud, dishonesty, deceit, misrepresentation, or committing any of the following:

    a. Knowingly supplying incorrect information, including Personal Data digitally or otherwise, including at the time of booking a flight on the Akasa Website/Akasa Mobile App and/or on the website of the Akasa Elevate Programme Partner, to earn Elevate Points.

    b. Attempting to earn Elevate Points for Sectors that have not been flown or for activities that are not eligible to earn Elevate Points as per the Terms and Conditions.

    c. Altering any Programme Partner documents to procure Elevate Points.

    d. Attempting to earn Elevate Points for Akasa Flights flown by any person other than the Member.

    e. Unauthorized creation of an Akasa Elevate Membership Account in the name of an individual (identity theft).

  • Indemnified Party(ies)

    Means Akasa, Akasa Elevate Programme Partners and service providers involved with the Loyalty Programme, and their affiliates, directors, officers, employees, representatives, agents, successors and assigns.

  • Personal Data
    Means and refers to such digital information that directly or indirectly relates to or reveals the identity of a Member that is processed by Akasa for the purposes of and in relation to the Akasa Elevate Programme.

  • Programme or Akasa Elevate Programme
    Means the loyalty program operated by Akasa under which Members may earn Elevate Points through eligible Accrual Activities and redeem such Elevate Points for rewards, benefits or other offerings made available under the Programme,

    and receive Tier-based benefits determined in accordance with the applicable Tier Qualification Criteria, all subject to these Terms and Conditions.

  • Lock Your Fare refers to a feature that allows passengers to hold the fare, at a specific price for a limited time (for up to 15 days, available up to 7 days before departure for domestic travel within India and for up to 30 days, available up to 15 days before departure for international travel from India) by paying a specified fee, instead of buying the ticket immediately. This gives prospective passengers time to finalize their plans before making a purchase.
  • Losses or Loss means any damages, charges, liabilities, claims, demands, actions, suits, proceedings, payments, judgments, settlements, awards, assessments, deficiencies, interest, penalties and costs and expenses (including reasonable attorneys' and consultant investigation, remediation and enforcement costs and expenses) imposed on, sustained, incurred or suffered by, or asserted against, the Indemnified Parties (whether in respect of third party claims, claims between Akasa and Member, or otherwise) provided that “Loss” shall not include indirect, consequential, special, punitive or exemplary losses.
  • Membership refers to membership to the Akasa Elevate Programme.
  • Promotional Activities shall include, but will not be limited to the promotion and/or marketing of the Programme, Elevate Points, loyalty benefits through television, press magazine, direct mailers, direct solicitation, displays, hoardings, web-based activities, mobile device solutions, and/or any other means that may be made available to promote, but will not be limited to Akasa Elevate, its Programme Partners, its promotion and media partners, or its vendors. For avoidance of doubt, Akasa undertakes Promotional Activities for and on behalf of Akasa Elevate Programme Partners as a data processor.
  • Qualifying Charge(s) means a category of charge incurred by a Member in connection with an Accrual Activity that qualifies for the accrual of Elevate Points, including: (a) the Base Fare; (b) select Add-ons identified by Akasa from time to time; and (c) any other charges designated by a Programme Partner as qualifying for the accrual of Elevate Points.
  • Qualifying Spend means the amount paid by a Member towards the Base Fare of a Qualifying Flight (excluding through the Redemption of Elevate Points), that qualifies for the accrual of Elevate Points and the determination of a Member’s Tier status.
  • Qualifying Flight or Eligible Flight means an Akasa Flight flown by a Member in respect of which such Member has incurred a Qualifying Spend.
  • Sector refers to a single non-stop journey on an airline between two destinations and on the same flight number, e.g., Delhi–Mumbai. A return flight between Delhi and Mumbai would mean 2 (two) Sectors.
  • Terms and Conditions refer to the terms and conditions that govern the Akasa Elevate Programme, as provided in this Membership Agreement and which may be amended from time to time.
  • Tier means the membership level assigned to a Member of the Akasa Elevate Programme, upon enrolment or following a review of the Member’s Tier status in accordance with the Tier Qualification Criteria.
  • Tier Benefits or Benefits mean the benefits made available to a Member by virtue of belonging to a particular Tier as determined by Akasa from time to time.
  • Tier Qualification Criteria means the eligibility criteria prescribed under these Terms and Conditions, including the Qualifying Spends incurred and the number of Qualifying Flights undertaken by a Member, on the basis of which a Member may be eligible to attain, retain, or upgrade to a particular Tier under the Programme.
  • Tier Review means a review of a Member’s Account by Akasa to:

    i. determine whether such Member has met the relevant Membership Tier Requirements to retain their existing Membership Tier; or

    ii. determine whether such Member has met the relevant Membership Tier Requirements to be upgraded into the next Membership Tier.

    Only the Tier Qualification Criteria that have been fulfilled shall be considered for a Tier Review. Failure to meet the applicable Tier Qualification Criteria shall result in the Member being downgraded to a lower Tier, as per these Terms and Conditions.

  • Tier Validity Period means a period of 365 (three hundred and sixty-five) consecutive days considered from the date on which a Member attains or retains a Tier status, during which such Tier status and the associated Tier Benefits shall remain valid, unless otherwise specified under these Terms and Conditions.
    1. Membership to the Akasa Elevate Programme is a privilege extended to individuals who are enrolled with Akasa Elevate Programme in accordance with the Terms and Conditions and is not in lieu of any consideration.
    2. Membership is open only to natural persons who are at least eighteen (18) years of age and competent to contract under Applicable Law. Corporations, partnerships, trusts and other legal entities are not eligible for Membership. Each Member may maintain only one Membership Account.
    3. Membership is non-transferable, except upon the death of a Member where transfer to legal heirs may be permitted in accordance with these Terms and Conditions.
    4. Membership to the Akasa Elevate Programme entitles the Member to accrue Elevate Points for activities solely undertaken by the Member.
    5. Akasa Elevate Programme Membership is valid for the lifetime of the Member unless terminated or revoked in accordance with these Terms and Conditions and may be inherited by the legal heirs of the Member subject to these Terms and Conditions.
    6. The Member agrees that:

      a. by participating in the Akasa Elevate Programme;

      b. by making use of any of the offers or privileges provided by any of the Akasa Elevate Programme Partners;

      c. as long as there is Accrual Activity on the Akasa Elevate Membership Account;

      d. by Redemption of Elevate Points;

      e. by virtue of the Akasa Elevate Membership Account not being deactivated (each of (a), (b), (c), (d), and (e) to be hereinafter construed as “Continued Participation”), such Member consents to the Terms and Conditions of the Akasa Elevate Programme, as may be amended from time to time at the sole discretion of Akasa.

    7. A Membership ID shall be generated for a Member only after explicit acceptance of these Terms and Conditions, either via click-wrap or an equivalent mechanism.
    8. A Member must quote their Membership ID and name as mentioned on their Akasa Elevate Membership Account when booking and checking in for flights with Akasa and/or using the services of an Akasa Elevate Programme Partner. Failure by a Member to provide the required Membership Programme ID and related information accurately when making such bookings or availing such services may result in the applicable Elevate Points not being credited to the Akasa Elevate Membership Account, and Akasa or its Akasa Elevate Programme Partner will not be responsible in this regard.
    9. The Akasa Elevate Membership Account or Elevate Points are not legal tender or a regulated payment instrument and cannot be exchanged for cash or any other form of payment tender but may be used for Redemptions/payments within the Akasa Elevate Programme in accordance with the Terms and Conditions.
    10. If benefits, facilities, or arrangements are provided or made available to a Member as a result of their Akasa Elevate Programme Membership, whether these are provided by Akasa or by any other Akasa Elevate Programme Partner, such a Member will be personally liable for any and all costs, taxes, surcharges, fees, charges, claims or liabilities of whatever nature arising from the provision or availability or usage of such benefits, facilities or arrangements.
    11. The Akasa Elevate Programme Membership, the Membership Account and all associated benefits always remain the property of Akasa. Subject to Applicable Law and these Terms and Conditions, Akasa reserves the right, in its sole discretion, to refuse any application for Membership, and to suspend, terminate, revoke, downgrade or otherwise restrict a Membership, Membership Tier or associated benefits where a Member breaches these Terms and Conditions, engages in Fraud, abuse or misuse of the Programme, provides inaccurate information, acts in a manner prejudicial to Akasa or the Programme, or where such action is reasonably required for operational, regulatory, security or legal reasons. To the fullest extent permitted by Applicable Law, Akasa shall not be liable for any loss arising from the exercise of such rights.
    12. While Akasa Elevate will use reasonable efforts to make available the services, benefits, facilities and arrangements advertised or offered by Akasa or any Akasa Elevate Programme Partner, the availability and provision of such services, benefits, facilities and arrangements are subject to the applicable terms and conditions of the relevant Akasa Elevate Programme Partner. Akasa does not control and is not responsible for the acts, omissions, products or services of any Akasa Elevate Programme Partner and, to the fullest extent permitted under Applicable Law, shall not be liable for any loss or damage arising from the provision, non-provision or use of such services, benefits, facilities or arrangements.
    13. Members may email Akasa Elevate Programme support team at care@elevate-akasaair.in to report instances of Fraud or resolve their other queries.
    1. Applicants may apply to enrol in the Akasa Elevate Programme online at www.akasaair.com or through Akasa’s Mobile App. The application forms will not be processed and treated as valid unless completed correctly with all the mandatory fields filled in by the applicant.
    2. An application to join Akasa Elevate deems the acceptance of all the Terms and Conditions.
    3. It is the responsibility of the individuals enrolling for Membership to the Akasa Elevate Programme to provide accurate details of and with respect to themselves, such as name, date of birth, gender, email ID, mobile number, etc. Applications will not be considered for enrolment if any of the details provided at the time of enrolment are found to be incorrect or incomplete. Membership may, at the sole discretion of the Akasa Elevate Programme, be revoked if any such detail pertaining to a Member is found to be incorrect.
    4. Akasa may accept or reject any application for Membership at its absolute discretion.
    5. Members are expected to ensure that they take appropriate care of their account details to prevent unauthorized persons from accessing their Akasa Elevate Membership Account and are expected to inform Akasa immediately in writing if they become aware that someone has gained unauthorized access to their Akasa Elevate Membership Account details. Akasa will not be responsible for any loss suffered by the Member on account of unauthorized access to the Member’s Akasa Elevate Membership Account.
    6. The Akasa Elevate Programme is designed and offered to Akasa patrons in their individual capacities. Each individual Member can maintain only one Akasa Elevate Membership Account with a unique registered email and a unique registered mobile number along with their full expanded name, which is present in their proof of identity.
    7. If more than one Membership ID is assigned to the same individual (duplicate accounts), Akasa reserves the right to merge the two accounts. In the event the same e-mail ID/mobile number is updated in more than one Akasa Elevate Membership Account, then all such accounts will be deactivated. Such account(s) will be activated only when the respective Member(s) amends the respective email IDs/mobile numbers. The mobile numbers and email IDs will be verified through the authentication procedure of the Akasa Elevate Programme such that each account has a unique email ID/unique mobile number recorded against the same.
    8. By enrolling in the Akasa Elevate Programme, Members consent to receive communications, notices, disclosures and updates relating to the Programme electronically through email, SMS, the Akasa Website, the Mobile Application, or other electronic means determined by Akasa. Such communications shall be deemed delivered when published or transmitted through such channels.
    1. For any changes pertaining to correction in the Member’s name and date of birth, it is the responsibility of the Member to inform Akasa by writing to the Akasa customer care.
    2. Requests for changes/corrections by a Member should be accompanied by supporting documentation, as may be specified at the time of making the change request, regarding name, date of birth, gender, update/correction in identity proof documents, etc.
    3. Members may also update their address and other details (except for mobile number and email address) online by logging on to their Akasa Elevate Membership Account on the Akasa Website or Akasa Mobile App.
    4. Members are responsible for maintaining the confidentiality of their Akasa Elevate Membership Account, protecting and keeping their Membership and Akasa Elevate Membership Account information secure, including online credentials, passwords, and the Membership ID, and taking care to prevent misuse by ensuring that no unauthorized third party has access to their Membership and Akasa Elevate Membership Account information.
    5. Members agree to accept responsibility for all activities that occur through their Akasa Elevate Membership Account.
    6. Members should take all necessary steps to ensure that the Membership ID/details, login ID, and password are kept confidential and secure. In cases of suspected wrongful access or misuse of the Membership or Akasa Elevate Membership Account information, Members must notify Akasa immediately of such occurrence by calling the Akasa customer care helpline number or writing to the Akasa customer care. Akasa will not be responsible for any loss suffered by the Member on account of unauthorized access to the Member’s Akasa Elevate Membership Account. Akasa Elevate is not liable for any Loss, damages, claim, or expense, including any legal costs.
    7. A Member cannot amend their email ID or mobile number through their Akasa Elevate Membership Account on the Akasa Website or Akasa Mobile App. The Member must contact Akasa customer care to facilitate such amendment by submitting valid government-issued proof authenticating the identity of the Member and such other documents as may be required by Akasa to support the request. Akasa may, in its sole discretion, amend the email ID or mobile number as requested by the Member only if it is satisfied as to the veracity of the claim. Akasa Elevate bears no responsibility for any loss caused to the Member on account of such amendment. Akasa is not liable for any Loss, damages, claim, or expense, including any legal costs.
    8. For any escalations, a Member may contact the following official of Akasa designated as the ‘Grievance Officer’:

    1. For withdrawal of consent by Akasa Elevate Programme Partners, a Member must reach out to the relevant Akasa Elevate Programme Partners for exercise of their data protection rights and redressal of their grievances. Should a Member contact Akasa with requests and grievances, Akasa shall reasonably endeavour to provide the Member the details of Akasa Elevate Programme Partners and route their communications to the concerned Partner.
    2. Akasa will make best endeavours to provide alerts related to the Akasa Elevate Programme via SMS, E-mail, telemarketing, push notifications, social media, etc. to the registered mobile phone number or e-mail ID provided by the Member. Akasa shall not be under any obligation to confirm the authenticity of the person(s) receiving the alert. Akasa is not liable for the non-availability of the SMS/email alert/push notifications service in any manner whatsoever.
    1. Elevate Points may be accrued by a Member only for Qualifying Charges incurred on:

      a. the Base Fare of Akasa Flights (after adjusting for discounts and excluding taxes and statutory levies); and

      b. purchase of select Akasa ancillaries/add-ons after adjusting for discounts and excluding taxes and statutory levies, in each case in accordance with these Terms and Conditions.

    2. For itineraries comprising multiple Sectors (including connecting flights involving a change of flight number), Elevate Points shall be calculated based on the Base Fare applicable to each Sector.

      a. Elevate Points accrual may vary based on booking channel (Akasa website/app, third-party platforms, travel agents, corporate channels); and

      b. the Member’s Tier as on the date of flight departure, regardless of Tier status on the date of booking.

      c. For partially flown tickets on Eligible Flights, no Elevate Points will be credited. By way of illustration only, if a Member has booked a flight from Delhi-Mumbai and a connecting flight from Mumbai to Kochi, and the Member has only flown the Delhi-Mumbai Sector, no Elevate Points will be credited to their Membership Account.

    3. Elevate Points shall be credited only upon:

      a. full payment of the booking; and

      b. completion of the flight, with the booking status reflected as “Boarded / Flown” in the PNR.

    4. Elevate Points will be credited only for the Member’s own travel and ancillaries, and not for other passengers, even if paid for by the Member.
    5. Elevate Points shall be credited only once per Sector per Member, irrespective of the number of seats purchased.
    6. Akasa reserves the right to modify the accrual structure (including earn rates and eligibility) from time to time, as communicated on the Akasa Website or Mobile Application.
    7. Akasa may take a maximum of thirty (30) days to credit a Member’s Account with Elevate Points from the date of any earning activity where the Membership ID has been provided at time of booking. Elevate Points earned by a Member may only be used or redeemed by that Member (in accordance with these Terms and Conditions) once they have been credited to such Member’s Account.
    8. Accrual of Direct Channel Bonus Points under the Akasa Elevate Programme is available only in respect of Qualifying Flights purchased by individual retail customers through Akasa’s direct channels or Akasa’s other points of sale in India. Elevate Points shall not accrue in respect of tickets purchased, issued, distributed or otherwise sold through any business-to-business (B2B) channels, including but not limited to tour operator bookings, bulk ticket purchases, and group bookings.
    1. Elevate Points shall accrue only on scheduled revenue flights. No Elevate Points shall accrue on:

      i. Lost, refunded, forfeited, unused or expired tickets.

      ii. Tickets with discounts over and above published fares, free of charge tickets, charter flights, complimentary tickets, agent and travel industry discount tickets.

      iii. Airline staff tickets.

      iv. Rebate, subsidized or any prize tickets.

      v. Add-on products sold or fulfilled through third-party.

      vi. Any other special purpose flights including but not limited to government evacuation or repatriation flights, relief or humanitarian aid flights and rescue or emergency response flights.

      vii. Select Akasa ancillaries where the underlying booking involves full or partial Redemption of Elevate Points.

      viii. Fees paid towards the Lock Your Fare feature.

      ix. For infant and minor passengers, whether travelling unaccompanied or where accompanied by a Member.

      x. Cancelled flights or flights which are transferred to another airline due to a Force Majeure Event.

      xi. Such other fares as Akasa may exclude from time to time.

    Channel Bonus Elevate Points shall apply only to bookings made directly through the Akasa Website or Mobile Application.

    1. Accrual Activities where Elevate Points were not automatically credited.
    2. A Retro Claim must be submitted within ninety (90) days from the date of travel.
    3. Discretionary extension of Retro Claim window: Akasa may, at its discretion, permit credit of Elevate Points retrospectively beyond the 90-day period in exceptional circumstances, including but not limited to:

      (i) Akasa system outages or technical errors;

      (ii) Force Majeure events impacting travel, systems or customer access;

      (iii) Operational errors attributable to Akasa or its Loyalty Programme Partners;

      (iv) Any promotions or offers that require such extension; or

      (v) Such other circumstances where strict enforcement of the 90-day window would result in systemic or demonstrable inequity.

    4. Members must retain travel documentation (including boarding passes and tickets) and provide reasonable proof of travel where requested by Akasa to support a Retro Claim.
    5. Akasa may take a maximum of forty-five (45) days to credit a Member’s Account with Elevate Points from the date of raising a request for a Retro Claim. Elevate Points credited to a Member’s Account may only be used or redeemed by that Member (in accordance with these Terms and Conditions) once they have been credited to such Member’s Account.
    1. Akasa reserves the right to reverse or adjust Elevate Points or Tier Benefits that have been incorrectly credited due to error, misuse, fraud or system inaccuracies.
    2. Elevate Points credited as goodwill or promotional bonuses shall be governed by the specific terms applicable to such issuance.
    3. Members shall notify Akasa of any discrepancies by writing to the Akasa customer care.

    Any booking made through, ticketed by, issued by, sold by or otherwise facilitated by a partner airline, including Etihad Airways, for travel on flights operated by Akasa Air shall not be eligible for the accrual of Elevate Points, unless otherwise expressly communicated by Akasa.

    1. Tier levels. The Programme offers multiple membership tiers (each, a "Tier"). The tiers available under the Akasa Elevate Programme and the associated eligibility criteria, Tier review methodology (where relevant), and Tier Benefits are set out in the Tier table at " Akasa Elevate Tier Table ("Tier Table").
    2. Qualification basis. A Member’s eligibility to upgrade, retain or be downgraded between Tiers is determined by reference to the Tier Qualification Criteria set out in the Tier Table, which may include (as applicable) Qualifying Spends and Qualifying Flights credited to the Member’s Account.
    3. Review cadence and effect. Tier review shall be carried out in accordance with the Tier Table. Upon completion of a Tier review:

      a. Akasa will confirm the Member’s Tier for the next Tier Validity Period; and

      b. Tier Benefits (if any) for the applicable Tier will be issued/available in accordance with these Terms and the Tier Table.

    4. Validity. Each Tier (other than the base/entry Tier, if any) and the Tier Benefits associated with that Tier are valid for the Tier Validity Period stated in the Tier Table, unless otherwise stated in these Terms.
    5. Where criteria are not met (downgrade). If a Member does not meet the Tier Qualification Criteria for retention of their Tier at the end of the applicable Tier Validity Period, the Member will be downgraded to the applicable lower Tier as set out in the Tier Table.
    6. Tier Table is authoritative. The Tier Table contains the commercial parameters (including thresholds, Tier criteria, benefit quantum, and validity windows). Where there is any inconsistency between these Terms and the Tier Table on such commercial parameters, the Tier Table shall prevail.
    7. Updates to the Tier Table. Akasa may update Schedule 1 (Tier Table) from time to time and any such update will apply prospectively unless expressly stated otherwise.
    8. Unless otherwise specified by Akasa, the aggregate Qualifying Spend or the number of Qualifying Flights completed during the preceding 365 (Three Hundred Sixty-Five) consecutive days shall be considered for Tier review.
    1. Elevate Points shall remain valid so long as the Member's Akasa Elevate Membership Account records at least one qualifying Accrual Activity or award/redemption activity in any continuous twenty-four (24) month period.
    2. At the end of each calendar month, Akasa shall review each Membership Account to determine whether there has been at least one qualifying activity during the preceding twenty-four (24) months. A qualifying activity means a completed Accrual Activity or Award/redemption activity for which the corresponding Elevate Points have been credited to or debited from the Membership Account at the time of review. Cancelled activities and goodwill credits shall not constitute qualifying activities. If no qualifying activity has occurred during the preceding 24-month period, all unredeemed Elevate Points in the Membership Account shall expire and shall not be reinstated.
    3. If an Award activity, which used up any Elevate Points that would have expired on a certain review date, is subsequently cancelled after such review date, all the Elevate Points used for such Award activity will immediately cease to be valid.
    4. Accrual Activities that are pending or whose status is on hold will not be considered eligible Accrual Activities for the purpose of review of the validity of the available balance of Elevate Points as on such review date.
    5. Redeposit of Elevate Points, charges towards setting up of any account, penalty charges for cancellation of any Awards will not be considered as eligible activities for the purpose of review of the validity of the available balance of Elevate Points as on such review date.
    6. If an Award/Redemption activity is cancelled after a review date, any Elevate Points that would otherwise have expired on that review date shall immediately expire and shall not be reinstated.
    7. Elevate Points that have expired shall not be reinstated, including where qualifying Elevate Points are subsequently credited retrospectively.

    1. Akasa reserves the right, at any time and in its sole discretion, to modify or suspend the Akasa Elevate Programme, or any part thereof, including its structure, features, benefits, partners, or eligibility criteria, subject to the notice framework set out below.
    2. Any modification that is material or structural in nature, including:

      i. earn or burn ratios;

      ii. validity or expiry of Elevate Points;

      iii. membership tiers, tier qualification or retention criteria; or

      iv. core Programme mechanics,

      shall, where such change is reasonably expected to have an adverse effect on Members, be communicated at least thirty (30) days in advance of the implementation of such changes, by publication on the Akasa Website and/or Mobile Application. Changes that are promotional, operational, or for a limited-duration in nature (including bonus offers, partner-specific promotions, seasonal campaigns, or temporary benefits) may be implemented with immediate effect, without advance notice, unless expressly stated otherwise.
    3. Unless expressly stated by Akasa, any modification to the Akasa Elevate Programme shall apply prospectively. Elevate Points already validly earned by a Member shall not be reduced or withdrawn retrospectively, except where such points have been credited as a result of Fraud, misrepresentation, abuse of the Akasa Elevate Programme, or error (including technical or system errors).
    4. Akasa shall not be liable for the withdrawal, suspension, limitation or modification of any services, benefits or facilities offered by any Programme Partner. Akasa disclaims all liability arising from any change or termination of partner relationships or partner-provided benefits, whether or not a Member has received notice of such change.
    5. Failure to receive, access, or become aware of any notice relating to modifications or termination of the Akasa Elevate Programme by a Member shall not give rise to any claim or liability against Akasa.
    6. Members can cancel their Membership at any time by submitting the appropriate written notification via an email to Akasa via the Akasa customer care, through their registered email ID.
    7. Membership of the Akasa Elevate Programme is voluntary. However, if an individual is seeking a particular service or offering specific to the Akasa Elevate Programme, then it is mandatory for such individual to be a Member of the Akasa Elevate Programme to avail of such service or offering.
    8. Akasa reserves the right to enrol only such individuals in its Membership who reside in certain countries and/or regions. Such countries and/or regions are subject to change at Akasa’s sole discretion. Nothing in these Terms and Conditions shall be construed to override or circumvent any such foreign laws which prohibit membership and participation from certain countries/regions in the Akasa Elevate Programme (either wholly or partly).
    9. Members must not act in any way which breaches these Terms and Conditions, indulge in any Fraudulent Activity, or abuse or misuse any benefits, facilities, services, arrangements, etc., accorded to the Member because of their Membership.
    10. Only the Member themselves (except as otherwise provided for lawful guardian in case of persons with disabilities or nominees of the Members), is eligible to obtain information from the Akasa Elevate Programme relating to their Membership, including but not limited to Accrual Activities, Awards, etc.
    11. The Member must ensure they have the correct visa, travel documents, and inoculations (including those for infants) for travel.
    12. Membership is offered at the discretion of Akasa and Akasa may, in its absolute discretion and without giving notice to any person, refuse to grant Membership, revoke Membership, or refuse or withdraw an upgrade (as applicable) to any Tier of Membership or Tier Benefits of the Member’s existing Tier, with or without assigning any reason thereof. In such an instance, any unutilized Elevate Points, Tier Benefits and Awards (as applicable) that may have been issued and have not been redeemed will stand revoked.
    13. Deactivation of Membership

      a. A Member may, at any time, request the temporary deactivation of their Membership Account through the Akasa website, mobile application or such other channels as may be designated by Akasa from time to time.

      b. During the period of deactivation:

      i. the Member shall not be entitled to accrue, redeem, transfer or use Elevate Points;

      ii. all Elevate Points, Tier Status, Tier Benefits, rewards, privileges and other Programme benefits shall remain on hold;

      iii. the Member shall not receive any promotional, marketing or programme-related communications in relation to the Akasa Elevate Programme; and

      iv. the Membership Account may remain inactive for a maximum period of twenty four (24) months, until reactivated by the Member.

    14. Reactivation of Membership

      a. A Member may request reactivation of their deactivated Membership Account through the Akasa website, mobile application or such other channels as may be designated by Akasa from time to time.

      b. Upon successful reactivation, the Member's Account, Elevate Points balance, Tier Status, Tier Benefits and Programme privileges that were on hold at the time of deactivation shall be reinstated, subject to these Terms and Conditions and any applicable expiry periods.

    1. In the event of the death of a Member, Akasa may, at its sole discretion, credit all or a portion of such Member's accrued Elevate Points to the nominee of such Member, or to the legal heir of the Member where such legal heir is also a Member, upon receipt of documentation satisfactory to Akasa and payment of applicable fee, if any. Such redemption can be made within such duration as determined by Akasa.
    2. The nominee/legal heir of the deceased Member may write to Akasa at the Akasa customer care, and provide the Government issued Death Certificate, Membership ID or registered email ID of the deceased Member, Membership ID of the legal heir (as applicable) and identity proof/relationship proof of legal heir with the deceased Member. Akasa may, at its discretion, seek any other document it may deem relevant to determine the veracity of the claim/request.
    3. In case of multiple legal heirs, Elevate Points will be transferred to the legal heir's Akasa Elevate Membership Account who has been identified as nominee, and where no nomination exists, whose request for transfer is first received by Akasa at the Akasa customer care, subject always to receipt of documents satisfactory to Akasa.
    4. Only the Elevate Points accumulated as of the date of demise of a Member will be transferred to/redeemed by their nominee/legal heir. All Tier Benefits, vouchers, or any other benefits associated with the Akasa Elevate Membership Account of the deceased Member will stand forfeited.

    1. Termination, Suspension and Other Actions by Akasa

      a. Without limiting any other rights or remedies available to Akasa under these Terms and Conditions or Applicable Law, Akasa may, at any time and in its sole discretion, suspend or terminate a Member's Membership and/or Account with immediate effect and without prior notice if:

      i. the Member engages in or attempts to engage in any Fraudulent Activity;

      ii. the Member engages in any activity or conduct which, in Akasa's reasonable opinion, is intended to circumvent, abuse or otherwise misuse the Akasa Elevate Programme, these Terms and Conditions or any benefit, privilege or reward associated with the Akasa Elevate Programme;

      iii. the Member breaches these Terms and Conditions, the Conditions of Carriage or any Applicable Law;

      iv. the Member infringes the rights of Akasa, any other Member or any third party;

      v. the Member acquires or attempts to acquire another Member's ID, password or personal information without the consent of such Member; or

      vi. the Member engages in abusive, threatening, coercive, intimidating, defamatory or otherwise inappropriate behaviour towards Akasa, its employees, agents or representatives, or publishes false or misleading information that adversely affects the reputation or business interests of Akasa or the Akasa Elevate Programme.

      b. As an alternative to termination, Akasa may, in its sole discretion, suspend the Member's Account, reverse or deduct Elevate Points, Qualifying Spends or other programme credits, downgrade or revoke Tier Status or Tier Benefits, restrict access to Programme benefits, or impose such other reasonable restrictions as it considers necessary.

    2. Termination by a Member

      A Member may terminate their Membership at any time by submitting a request through the channels designated by Akasa from time to time. Termination shall become effective upon closure of the Membership Account by Akasa.

    3. Consequences of Suspension or Termination

      Suspension by Akasa

      Where a Membership or Account is suspended by Akasa:

      a. the Member shall not be entitled to accrue, redeem, transfer or use Elevate Points during the period of suspension;

      b. all Tier Status, Tier Benefits, rewards and programme privileges may be suspended; and

      c. Akasa may freeze the Member's Account while investigating any suspected breach of these Terms and Conditions.

    4. Termination by Akasa

      Upon termination of a Membership by Akasa:

      a. the Membership Account shall be closed;

      b. all unredeemed Elevate Points shall immediately expire and be forfeited;

      c. all Tier Status, Tier Benefits, rewards, vouchers and other programme privileges shall be cancelled;

      d. Akasa may cancel or revoke any reward, benefit, voucher or Award Flight obtained using Elevate Points; and

      e. the Member may be prohibited from opening a new Membership Account except with Akasa's prior approval.

    5. Termination by a Member

      Upon termination of Membership by a Member:

      i. the Membership Account shall be closed;

      ii. all unredeemed Elevate Points shall immediately expire and shall not be capable of redemption, transfer or reinstatement; and

      iii. all Tier Status, Tier Benefits and Programme privileges shall cease.

    6. General

      No cash payment, compensation, refund or other consideration shall be payable in respect of any expired, forfeited, cancelled or unused Elevate Points, Tier Benefits or Programme privileges arising from any suspension or termination of Membership.

    1. Collection and Use of Personal Data

      By enrolling in or using the Akasa Elevate Programme, Members consent to Akasa collecting, using, storing and processing their Personal Data for the purposes of operating and administering the Programme.

      Personal Data may include:

      a. Membership information (such as name, address, contact details, date of birth and preferences);

      b. Travel information (including flights taken, Elevate Points earned and travel class); and

      c. Information relating to a Member's interactions with Akasa and the Programme.

      d. Akasa may also receive information from Akasa Elevate Programme Partners relating to Elevate Points earned through eligible partner transactions.

    2. Personal Data may be used for purposes including

      a. enrolment and account management;

      b. administration and operation of the Programme;

      c. accrual, redemption and fulfilment of rewards and benefits;

      d. personalization and Member engagement;

      e. providing products, services and benefits offered through the Programme;

      f. customer support and grievance handling;

      g. legal and regulatory compliance; and

      h. communication relating to the Programme.

    3. Sharing of Personal Data

      To operate and administer the Programme, Akasa may share Personal Data with its affiliates, service providers, suppliers and Akasa Elevate Programme Partners, on a need-to-know basis.

      Akasa Elevate Programme Partners are independent data fiduciaries and are separately responsible for their collection, use and protection of Personal Data in accordance with applicable law and their respective privacy policies. Akasa shall not be responsible for any acts or omissions of such partners in relation to Personal Data processing.

    4. Marketing Communication

      Where a Member has provided consent, Akasa may send information relating to:

      a. the Akasa Elevate Programme;

      b. rewards, Promotional Activities and offers;

      c. products and services offered by Akasa; and

      d. promotions and offers provided through Akasa Elevate Programme Partners.

    5. Members may withdraw their consent or update their communication preferences at any time through the Akasa Website, Akasa Mobile App, customer care channels or by contacting the ‘Grievance Officer’.

    6. Withdrawal of consent may result in certain Programme-related communications or services no longer being available.
    7. Legal Disclosures and Audits

      Akasa may disclose Personal Data and Membership account information:

      a. where required by Applicable Law;

      b. to regulatory, governmental, law enforcement, immigration, customs or other competent authorities; or

      c. to professional advisers, auditors, investigators or third-party service providers engaged by Akasa for compliance reviews, audits or investigations relating to the Programme.

    8. Privacy Policy

      Akasa will process and protect Personal Data in accordance with its Akasa Air Privacy Policy as updated from time to time.

    9. Account Security

      a. Members are responsible for maintaining the confidentiality and security of their Membership ID, login credentials, passwords and other account information. Members must not disclose their account credentials to any third party. Any activity undertaken using a Member's account credentials may be treated as authorised by the Member, unless otherwise required by applicable law.

      b. If a Member becomes aware of or suspects any unauthorized access to or use of their account, the Member must immediately notify Akasa through the customer care channels.

    10. Identity Verification

      Before disclosing Membership account information, Akasa may require a Member to verify their identity by providing information or answering security questions reasonably requested by Akasa.

    1. To the maximum extent permitted by Applicable Law, Akasa, its affiliates, and Akasa Elevate Programme Partners shall not be liable to any Member or any person claiming through a Member for any indirect, incidental, special, consequential, exemplary or punitive damages, including loss of opportunity, loss of goodwill, loss of anticipated savings or loss of profits, arising out of or in connection with the Akasa Elevate Programme, Membership, Elevate Points, Awards, Tier Benefits or any Programme-related services.
    2. Akasa and the Akasa Elevate Programme Partners shall not be responsible for any delay, unavailability, suspension, withdrawal, modification or discontinuance of any Programme benefit, reward, service, facility, partner offering or redemption opportunity, except as required under Applicable Law.
    3. While Akasa will use reasonable efforts to make the Akasa Elevate Programme and related services available, Akasa does not guarantee uninterrupted availability of the Programme, Platform or any Programme-related services and shall not be liable for any loss arising from any Force Majeure event, interruption, suspension, technical error, system failure or unavailability, except to the extent caused by Akasa's wilful misconduct or fraud.
    4. Programme benefits provided by Akasa Elevate Programme Partners are offered by such partners on their own terms and conditions. Akasa shall not be responsible for the acts, omissions, products, services or representations of any Programme Partner, except to the extent expressly required under Applicable Law.
    5. Reasonable care is taken to ensure that information published in connection with the Akasa Elevate Programme is accurate as of the date of publication. However, Akasa does not warrant that such information will always be complete, accurate or current and reserves the right to correct any errors, omissions or inaccuracies at any time.
    6. Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under Applicable Law.

    1. The Member shall indemnify the Indemnified Parties from and against all Losses incurred, suffered or sustained by any Indemnified Party, arising out of, resulting from, or in connection with any breach by the Member of these Terms and Conditions.

    Governing Law & Dispute Resolution

    1. These Terms and Conditions shall be governed by and construed in accordance with laws of India.
    2. All disputes arising under the Terms and Conditions shall be attempted to be resolved through negotiations.
    3. Akasa and the Member submit to the exclusive jurisdiction of the courts of Mumbai to resolve any disputes that may arise between them regarding these Terms and Conditions, including in relation to the validity, interpretation, implementation or alleged breach of these Terms and Conditions.

    1. Any part of these Terms and Conditions that is unenforceable for any reason shall not be given any effect, and the remainder of these Terms and Conditions shall not be affected in any way.
    2. Akasa may transfer, assign, novate or otherwise transfer the Akasa Elevate Programme, in whole or in part, to any affiliate, successor, purchaser or other third party. Where such transfer is reasonably expected to materially affect Members' rights or benefits under the Programme, Akasa will provide reasonable notice to Members through the Akasa Website, Mobile Application or other communication channels determined by Akasa. Any transfer of personal data shall be subject to the applicable privacy policy and applicable laws.
